Terms and Conditions for Window Replacement Services
- Payment Terms
- Deposit: A deposit of 50% is required at the time of signing the agreement.
- Payment Schedule: The remaining balance is due as follows:
- 50% upon project completion.
- Late Payment Fees: Payments not received by the due date may incur a late fee of 5% or the elimination of certain discounts made in good faith with the homeowner at the time of purchase.
- Cancellation Policy: Customers may cancel the agreement within 3 business days of signing. Cancellations after this period may result in a fee equal to the cost of materials (i.e., custom-manufactured windows), marketing, and general administrative fees incurred plus an additional 20%.
- Delivery and Installation
- Timeline: Delivery and installation are typically completed within 8 to 12 weeks of order confirmation. This timeframe is subject to delays caused by factors beyond our control, including supplier issues and weather conditions.
- Access Requirements: Customers must ensure clear access to the work areas, including moving furniture and providing unobstructed paths to windows and doors.
- Weather Delays: Installation may be rescheduled due to adverse weather conditions to ensure safety and quality.
- Warranties
- Product Warranty: All windows and doors are covered by a manufacturer warranty against defects. Warranty terms vary by product; please refer to the manufacturer’s documentation.
- Labor Warranty: Our installation workmanship is guaranteed for 5 years. This warranty does not cover damages caused by misuse, neglect, or improper maintenance.
- Exclusions: Warranties do not cover accidental damage, unauthorized modifications, or issues arising from structural deficiencies in the property.
- Customer Responsibilities
- Preparation: Customers are responsible for removing window coverings, securing pets, and clearing work areas before installation begins.
- Alarm Systems: Customers must arrange for the disconnection and reconnection of any alarm systems attached to the windows or doors.
- Exterior Landscaping: Any trees, shrubs, or plants obstructing access to windows must be pruned or relocated prior to installation.
- Liability
- Pre-existing Conditions: The company is not liable for damages to pre-existing conditions such as brittle trim, cracked plaster, or structural deficiencies that may worsen during installation.
- Insurance Coverage: The company maintains general liability and worker’s compensation insurance.
- Acts of God: The company is not responsible for delays or damages caused by unforeseen events such as severe weather, natural disasters, or other conditions beyond its control.
- Change Orders
- Scope Adjustments: Any changes to the scope of work must be requested in writing and may result in additional costs and timeline adjustments.
- Approval Process: Both parties must approve changes in writing before work continues.
- Permits and Regulations
- Compliance: All work will be performed in accordance with applicable building codes and regulations.
- Dispute Resolution
- Arbitration or Mediation: Any disputes arising from this agreement will first be addressed through arbitration or mediation before legal action is pursued.
- Jurisdiction: This agreement is governed by the laws of the State of Texas. Any legal action arising from this agreement must be filed in the courts located in Harris County, Texas.
- Completion and Acceptance
- Final Inspection: Upon project completion, the customer will inspect the work. Any issues must be reported immediately.
- Certificate of Completion: The customer must sign a completion certificate to confirm satisfaction with the work.
- Final Payment: The remaining balance is due upon project completion unless prior arrangements have been made.
- Miscellaneous
- Ownership of Materials: Materials remain the property of the company until full payment is received.
- Use of Photos: The company may use photos of completed projects for marketing purposes unless the customer requests otherwise in writing.
- Expiration of Quotes: Quotes are valid for 30 days from the date issued.
